Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of AI Growth Kit (the “Service”), operated by AI Growth Kit (“we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use the Service on your own. Users between 13 and 17 may use the Service only with verifiable consent from a parent or legal guardian, who accepts these Terms on the user's behalf. The Service is not directed to children under 13, and we do not knowingly accept accounts from anyone under 13.

2. Description of the Service

AI Growth Kit provides three AI-assisted video tools:

• Video Translator — regenerates the audio track of a user-supplied video in a different language and aligns it to the original timing. The Service does not modify the speaker's face, mouth movements, or any visual frame of the source video.
• Subtitler — generates time-coded subtitles from a video's audio. Output is delivered as an SRT file or as burned-in subtitles overlaid on the original video. This is a text-generation feature, not a video-generation feature.
• 4K Upscaler — applies AI super-resolution to enhance the spatial resolution of a user-supplied video. This is image/video upscaling, not generative content creation.

The Service does not offer image generation, video generation from text/audio prompts, face swap, deepfake, or any face/voice manipulation features.

3. Acceptable Use Policy

You are responsible for the content you upload and for how you use the Service's output. You agree not to upload, generate, distribute, or otherwise use the Service to produce or facilitate any of the following:

• Sexually explicit, pornographic, or NSFW content of any kind, including suggestive or sexually provocative material. The Service strictly prohibits the creation, processing, or distribution of NSFW or sexually explicit video content.
• Content sexualizing minors in any form — this is illegal and will result in immediate termination and reporting to authorities.
• Deepfakes, face swaps, or face/voice manipulation intended to impersonate a real person without their explicit written consent, or designed to deceive viewers about a person's identity, words, or actions.
• Non-consensual content involving identifiable individuals, including unauthorized translations or subtitling of private recordings.
• Hate speech, harassment, threats, or content inciting violence against any individual or group.
• Illegal content under the laws of your jurisdiction or the Hong Kong Special Administrative Region, including content infringing copyright, trademark, or other intellectual property rights.
• Malware, phishing, fraud, or any content intended to deceive, defraud, or harm third parties.
• Election interference, political disinformation, or content designed to materially mislead the public about real-world events.
• Attempts to bypass our safeguards, including reverse-engineering, probing for security weaknesses, or coordinating accounts to evade limits or moderation.

We may, at our sole discretion and without prior notice, remove content, terminate accounts, refuse service, and report unlawful content to the appropriate authorities. We may also retain prohibited content for evidentiary purposes as required by law.

4. Accounts

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately at thcbnu@gmail.com of any unauthorized use.

5. Credits, subscriptions, and billing

• The Service uses a credit system. One credit equals one second of output video. Pricing is published at /pricing.
• Subscription credits reset at the start of each billing cycle. One-time top-up credits do not expire.
• All payments are processed by our Merchant of Record, Creem, which acts as the seller of record for tax and billing purposes. Creem's own terms apply to the payment transaction.
• You may cancel your subscription at any time from your account portal. Cancellation takes effect at the end of the current billing period; you retain access to unused subscription credits until then.
• Failed-task refund: credits consumed by a task that fails due to our system are automatically refunded to your balance within 24 hours.
• Refund requests: we respond to refund inquiries within 3 business days. Discretionary refunds outside the failed-task policy are evaluated case-by-case.

6. Intellectual property

You retain all rights, title, and interest in the videos you upload and in the output files generated for you, subject to your warranty that you have the right to upload and process such content. You grant us a non-exclusive, worldwide, royalty-free license to process, store, and transmit your content solely as necessary to provide the Service.

We retain all rights to the Service itself, including its software, interface, brand, and documentation. AI Growth Kit is an independent service and is not affiliated with, endorsed by, or sponsored by the providers of any underlying AI models we may use.

7. Privacy

Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the output will meet your expectations. AI-generated translations and subtitles may contain inaccuracies; review the output before publishing.

9. Limitation of liability

To the maximum extent permitted by law, AI Growth Kit and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any direct damages will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 100.

10. Indemnification

You agree to indemnify and hold harmless AI Growth Kit and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising from (i) your use of the Service, (ii) your violation of these Terms, or (iii) your violation of any third-party right, including intellectual property or privacy rights.

11. Termination

You may stop using the Service at any time and delete your account from your dashboard. We may suspend or terminate your access for violation of these Terms, suspected fraud or abuse, or as required by law. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive.

12. Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.

13. Changes to these Terms

We may update these Terms. Material changes will be notified by email and via a notice on the site at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
